1. Acceptance of Terms
By accessing or using SwiftASL ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are a parent or guardian registering a child under 13, you agree to these Terms on behalf of your child. If you do not agree to these Terms, please do not use the Service.
2. Description of Service
SwiftASL is an educational web application designed to help Deaf children learn to read through ASL video flashcards. The Service allows students to:
- Record video flashcards of themselves signing words in ASL
- Practice reading through various flashcard activities
- Track their learning progress and word mastery
Parents and teachers can monitor student progress, assign word lists, and access learning reports.
3. User Accounts
3.1 Account Types
- Student accounts: For learners, with simplified authentication (6-digit PIN)
- Parent accounts: For parents/guardians to monitor their children
- Teacher accounts: For educators managing multiple students
- School Admin accounts: For school administrators managing teachers and students
3.2 Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
- Ensuring information provided is accurate and current
4. Parental Consent
In compliance with COPPA, we require verifiable parental consent before children under 13 can create accounts or have their personal information collected. Parents must:
- Review our Privacy Policy before providing consent
- Provide verifiable consent through our consent process
- Maintain the ability to review, delete, or restrict data collection
5. User Content
5.1 Video Content
Students create video recordings of themselves signing words. This content:
- Remains the property of the student/parent
- Is stored securely and accessible only to authorized users
- May be deleted at any time by the student, parent, or teacher
- Is subject to our content guidelines below
5.2 Content Guidelines
All video content must:
- Be appropriate for educational purposes
- Show only ASL signs related to learning activities
- Not contain inappropriate, harmful, or offensive content
- Not include other people without their consent
6. Acceptable Use
You agree NOT to:
- Use the Service for any unlawful purpose
- Attempt to access another user's account
- Upload malicious code or attempt to compromise security
- Interfere with the proper functioning of the Service
- Use automated systems to access the Service without permission
- Collect or harvest user information
- Use the Service in any way that could harm children
7. Intellectual Property
The SwiftASL platform, including its design, features, and content (excluding user-generated content), is owned by SwiftASL and protected by intellectual property laws. You may not copy, modify, or distribute our platform without permission.
8. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We may:
- Perform maintenance with reasonable notice when possible
- Modify or discontinue features with notice
- Experience interruptions due to circumstances beyond our control
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED. EDUCATIONAL OUTCOMES MAY VARY BASED ON INDIVIDUAL STUDENT FACTORS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWIFTASL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
11. Account Termination
We may suspend or terminate accounts that violate these Terms. You may close your account at any time. Upon termination:
- Your data will be soft-deleted and retained for 6 months
- You may request data export before or during this period
- After 6 months, data will be permanently deleted
12. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
13. Changes to Terms
We may update these Terms from time to time. We will notify users of material changes via email and/or prominent notice on the Service. Continued use after changes constitutes acceptance of the new Terms.
14. Governing Law
These Terms shall be governed by the laws of the United States and the State in which SwiftASL operates, without regard to conflict of law provisions.
